ALBUQUERQUE, N.M. —
Court records show charges against retired Albuquerque police Officer Rodney Locke have been dismissed.
According to police, Locke hit Kay Moss Freese with his car in September. Freese was in a wheelchair, and died from her injuries. Locke was charged with leaving the scene of a deadly accident.
Locke posted a $50,000 bond a couple of days after the crash, and has been out of jail since.
A spokesman from the Bernalillo County District Attorney’s Office said they had to drop the charges because they did not get all of the evidence they needed to prosecute the case within the required 60 day limit.
The spokesman said those charges will be refiled. One item that was pending was a toxicology report to show if Locke had been drinking when the crash happened. Locke refused a breathalyzer test the night of his arrest.
Police obtained a warrant for a blood test. An APD spokesperson said the toxicology results have been submitted to the DA’s office, and will be entered as evidence.
APD said when the charges are refiled, the new charge could be as severe as vehicular homicide.
